These terms govern your use of the Sold Simple mobile application and this website, both operated by Sold Simple LLC ("Sold Simple," "we," "us"). By creating an account or using the app, you agree to them.

1. What Sold Simple is

Sold Simple is an informational and educational tool. It produces an estimated property value from publicly and commercially available data, an assessment of condition based on information and photographs you provide, and written guidance about the home-selling process.

2. What Sold Simple is not

• Not an appraisal. Our valuation is an automated estimate. It is not a licensed appraisal, a broker price opinion, or a comparative market analysis prepared by a licensed professional, and it should not be used in place of one.
• Not real estate brokerage. We do not represent you in any transaction, do not act as your agent or broker, and do not owe you the duties a licensed agent would owe a client.
• Not legal, tax, or financial advice. Guidance about disclosures, contracts, contingencies, or taxes is general information, not advice about your situation. Real estate law and disclosure requirements vary by state and locality.
• Not a guarantee. We do not promise your home will sell, sell at any particular price, or sell within any timeframe.

3. Accuracy and limitations

Valuations depend on third-party data that may be incomplete, out of date, or wrong for your property. Automated systems, including the AI models we use, can produce results that are inaccurate or inappropriate for your circumstances. Property condition assessments are based on limited information and photographs and cannot substitute for an in-person inspection.

You are responsible for verifying anything you rely on. We recommend consulting a licensed appraiser, real estate agent, or attorney before setting a price or entering into any agreement.

4. Your account

You must be at least 18 to use Sold Simple. You're responsible for keeping access to your email account secure, since sign-in codes are delivered there, and for the accuracy of information you enter.

5. Your content

You keep ownership of the photographs and information you provide. You grant us a limited license to store and process that content in order to operate the service — including sending it to the third-party providers listed in our Privacy Policy to generate valuations, assessments, and guidance. You confirm you have the right to provide any photograph you upload.

6. Acceptable use

Don't use Sold Simple to break the law, misrepresent a property, infringe anyone's rights, attempt to access other users' data, scrape or resell our output, or interfere with the service's operation.

7. Beta software

Sold Simple is currently in beta testing. It may contain defects, may change substantially, and may be interrupted or discontinued. Features available today may not exist tomorrow. Please don't rely on it as your only record of anything important.

8. Third-party services

The app depends on services operated by other companies. We're not responsible for their availability, accuracy, or conduct, and their terms apply to their portions of the service.

9. Disclaimer of warranties

To the fullest extent permitted by law, Sold Simple is provided "as is" and "as available," without warranties of any kind, express or implied, including any warranty of merchantability, fitness for a particular purpose, accuracy, or non-infringement.

10. Limitation of liability

To the fullest extent permitted by law, Sold Simple LLC will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, lost sale proceeds, or any loss arising from a pricing or selling decision you make. Our total liability for any claim relating to the service will not exceed the greater of the amount you paid us in the twelve months before the claim or one hundred dollars.

Some jurisdictions don't allow certain limitations, so parts of this section may not apply to you.

11. Indemnification

You agree to indemnify and hold Sold Simple LLC harmless from claims arising out of your use of the service, your content, or your violation of these terms.

12. Termination

You may stop using Sold Simple at any time and request deletion of your account. We may suspend or terminate access if you violate these terms or if we discontinue the service.

13. Changes

We may update these terms. If a change is material, we'll update the date above and notify you where appropriate. Continuing to use the app after a change means you accept it.

14. Governing law

These terms are governed by the laws of the State of [STATE — to be confirmed with counsel], without regard to its conflict of laws rules. Any dispute will be brought in the state or federal courts located there.
